Profile

Joshua A. Hasko is a shareholder with Messerli Kramer and serves as the firm’s President. Hasko has been an active member of the firm’s board of directors and served as chair of the Business Litigation Department.  Josh is consistently included on the Minnesota Super Lawyers® list, which recognizes the top 2.5% of lawyers in the State and has been named to Super Lawyer’s® Top 100 List since 2016.  He is also regularly recognized for his work in commercial litigation as one of The Best Lawyers in America©.

Josh concentrates his practice on commercial business disputes, with an emphasis on complex contract and business tort litigation; creditor remedies and Uniform Commercial Code disputes including equipment leasing and secured transactions; fiduciary duty and shareholder claims; and real estate litigation.  He practices in state and federal courts, bankruptcy courts, appellate courts, and in arbitration proceedings.   

Josh is dedicated to client service and works with his clients to develop an aggressive and practical legal strategy consistent with their goals and objectives.   

Representative Experience
  • Represented national equipment lessor in multi-jurisdictional federal court action to obtain a significant monetary judgment and replevin orders directing the recovery of collateral in non-forum jurisdiction.

  • Represented private landowners in inverse condemnation trial against County, resulting in an Order granting writ of mandamus and directing reimbursement of attorneys’ fees and costs.

  • Represented Wisconsin entity in ownership dispute with alleged former shareholder, obtaining successful resolution.
  • Represented Minnesota entity in minority shareholder action, including representation before Special Litigation Committee.
  • Represented national equipment lessor in multi-jurisdictional federal and bankruptcy court litigation, successfully recovering a substantial amount of high dollar value collateral.

  • Represented national banking association in litigation to enforce personal guaranty agreements, successfully obtaining a significant summary judgment award and an award for recovery of attorney fees and costs.

  • Representation of multiple, national, equipment lessors in litigation over the execution, validity, and priority of liens in state and federal court actions.

  • Represented Minnesota company in breach of contract and fraud litigation originating in Minnesota state court and successfully resolving in United States Bankruptcy Court through an agreement for the entry of a non-dischargeable judgment.

  • Represented Minnesota company and its affiliates in successful nation-wide recovery of assets illegally obtained in a scheme to defraud clients, including coordination with law enforcement and counsel for U.S. Customs and Border Protection.

  • Represented majority owner in extended multi-million dollar fiduciary duty/partnership dispute, including trial and appellate court proceedings, successfully resolving dispute.  Hall v. Hall, Ramsey County District Court, File No. 62-CV-12-8604; Hall v. Hall, 2015 Minn. App. unpublished LEXIS 492.

  • Represented majority shareholder in multi-million dollar dispute commenced by minority owner, successfully negotiating resolution of claims.

  • Represented manufacturer in defense of breach of contract and Uniform Commercial Code (Article 2) litigation. After underlying claims were resolved, successfully obtained summary judgment against co-defendant distributor arising out of breach of distributor agreement that was affirmed on appeal before the Minnesota Court of Appeals. College City Leasing, LLC v. River Valley Truck Centers, Inc, et al., 2008 WL 3290759 (Minn. Ct. App. 2008) unpublished.

  • Represented communications company in lease dispute litigation against municipality, successfully obtaining award for summary judgment declaring the subject lease term valid and enforceable and providing for an award for recovery of attorneys fees and costs.

  • Represented national franchisor in successfully defense against $14 million dollar litigation commenced by former franchisee.

  • Represented creditor in Hennepin County, MN litigation; obtained substantial monetary judgment against former business associate arising out of default of promissory note obligations.

  • Served as a judicial extern for Chief Judge Paul A. Magnuson at the U.S. District Court, District of Minnesota.
